Como resultado, as aulas pararam. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Primeiramente, o direito de greve esta assegurado no artigo 9\u00ba da Constitui\u00e7\u00e3o Federal, e foi regulamentado pela Lei n\u00ba 7.783\/89, que disp\u00f5e sobre o exerc\u00edcio do mencionado direito, define as atividades essenciais e atendimentos urgentes que n\u00e3o podem ser interrompidos durante o movimento grevista, al\u00e9m de prever outras provid\u00eancias.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Aqui, vamos explicar, portanto, o funcionamento de uma greve e quais s\u00e3o os pr\u00f3ximos passos.<\/p>\n\n\n\n<div class=\"wp-block-group has-base-color has-text-color has-link-color wp-elements-48d86f94797f9bb45f0a7b051b644683 is-content-justification-center has-background\" style=\"min-height:1000px;margin-top:0;margin-bottom:0;padding-top:0;padding-bottom:0;background-image:url(&apos;https:\/\/brechando.com\/novo\/wp-content\/uploads\/2024\/04\/black-lives-matter-movement-copy-space-scaled-e1714403234354.jpg&apos;);background-position:8% 7.000000000000001%;background-size:cover;\"><div class=\"wp-block-group__inner-container is-layout-constrained wp-block-group-is-layout-constrained\">\n<div class=\"wp-block-group is-vertical is-content-justification-center is-nowrap is-layout-flex wp-container-core-group-is-layout-7b9a8042 wp-block-group-is-layout-flex\">\n<div class=\"wp-block-media-text has-media-on-the-right is-stacked-on-mobile is-vertically-aligned-center is-image-fill\" style=\"margin-top:var(--wp--preset--spacing--30);margin-right:0;margin-bottom:var(--wp--preset--spacing--30);margin-left:0;padding-top:var(--wp--preset--spacing--30);padding-bottom:var(--wp--preset--spacing--30);grid-template-columns:auto 34%\"><div class=\"wp-block-media-text__content\">\n<h3 class=\"wp-block-heading has-text-align-center has-base-2-color has-text-color has-link-color wp-elements-ba66461d3b6545c75cf5c1920b8ade8c\"><strong>1\u00ba passo &#8211; Cria\u00e7\u00e3o do sindicato<\/strong><\/h3>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">A cria\u00e7\u00e3o de um sindicato \u00e9 assegurado pela Constitui\u00e7\u00e3o de 1988: &#8220;\u00c9 assegurado o direito de greve, competindo aos trabalhadores decidir sobre a oportunidade de exerc\u00ea-lo e sobre os interesses que devam por meio dele defender.&#8221;. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\" style=\"font-size:1.2rem\">Por isso, o sindicato \u00e9 a garantia de que um coletivo de pessoas tenham seus direitos efetivamente concedidos.  <\/p>\n\n\n\n<p class=\"has-base-2-color has-text-color has-link-color has-medium-font-size wp-elements-4baab2f791fec7d53f32878e64022032 wp-block-paragraph\">Nas empresas (p\u00fablica ou n\u00e3o) de mais de duzentos empregados, \u00e9 assegurada a elei\u00e7\u00e3o de um representante destes com a finalidade exclusiva de promover-lhes o entendimento direto com os empregadores. Por isso, \u00e9 <strong>inconstitucional<\/strong> um grupo de pessoas serem demitidas por justa causa pelo simples fato de participar de uma greve ou ser do sindicato. <\/p>\n<\/div><figure class=\"wp-block-media-text__media\" style=\"background-image:url(https:\/\/brechando.com\/novo\/wp-content\/uploads\/2024\/04\/pexels-jibarofoto-2774556-1080x720.jpg);background-position:50% 50%\"><img decoding=\"async\" src=\"https:\/\/brechando.com\/novo\/wp-content\/uploads\/2024\/04\/pexels-jibarofoto-2774556-1080x720.jpg\" alt=\"\" class=\"wp-image-63346 size-medium\"\/><\/figure><\/div>\n<\/div>\n\n\n\n<div style=\"height:19px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h3 class=\"wp-block-heading alignfull has-text-align-center has-base-2-color has-text-color has-link-color has-small-font-size wp-elements-d0eaf63f05bb16a4e166b3bc07a025fc\" style=\"line-height:2.9\"><strong>2\u00aa passo &#8211; Assembleia do Sindicato<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Antes de dar in\u00edcio a greve, entidade sindical correspondente deve convocar uma assembl\u00e9ia geral que definir\u00e1 as reivindica\u00e7\u00f5es da categoria. E normal, ter muita discuss\u00e3o ou briga estilo DNA do Ratinho (principalmente entre situa\u00e7\u00e3o ou oposi\u00e7\u00e3o da dire\u00e7\u00e3o, <strong><span style=\"text-decoration: underline;\">dependendo dos sindicatos<\/span><\/strong>). No caso de servi\u00e7os considerados essenciais, esse aviso deve acontecer em 72 horas de anteced\u00eancia.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Os grevistas n\u00e3o devem em momento algum violar ou constranger os direitos fundamentais de outrem. E as manifesta\u00e7\u00f5es e atos de persuas\u00e3o utilizados pelos grevistas n\u00e3o poder\u00e3o impedir o acesso ao trabalho nem causar amea\u00e7a ou dano \u00e0 propriedade ou pessoa.<\/p>\n\n\n<div class=\"wp-block-image\">\n<figure class=\"aligncenter size-large is-resized\"><img decoding=\"async\" src=\"https:\/\/brechando.com\/novo\/wp-content\/uploads\/2024\/04\/pessoas-tendo-um-protesto-pelo-dia-mundial-do-meio-ambiente-1200x800.jpg\" alt=\"\" class=\"wp-image-63348\" style=\"width:401px;height:auto\"\/><\/figure>\n<\/div>\n\n\n<p class=\"wp-block-paragraph\">Constitui abuso do direito de greve a inobserv\u00e2ncia das normas contidas na Lei. Bem como a manuten\u00e7\u00e3o da paralisa\u00e7\u00e3o ap\u00f3s a celebra\u00e7\u00e3o de acordo, conven\u00e7\u00e3o ou decis\u00e3o da Justi\u00e7a do Trabalho.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A lei ainda aponta que o abuso do direito \u00e0 greve.
